Canada Europe Free Trade Agreement

This license exists only in one sense – states cannot sue companies in this investor-state arbitration procedure. Such complaints from investors are nothing new in international law (UNCTAD listed at the end of 2012 514 such cases, most of them from the United States, the Netherlands, the United Kingdom and Germany), but for transatlantic trade and investment, this broad level of parallel justice is new. Negotiations on food exports, in particular, have been very long.

Interests in European cheese exports and Canadian beef exports have led to the protection of this type of intellectual property and long lists of “geographic indications for the identification of a product originating in the European Union” (p. 363-347). [39] The parties recognize the growing importance of trade in services and investment in their economies. They agree to cooperate to create the most favourable conditions for investment expansion and further liberalization and reciprocal market opening to trade in services, taking into account the work underway under the aegis of the WTO. They also agree to encourage the competent authorities in their territory to cooperate in the mutual recognition of the accreditation and certification of professional service providers and to facilitate the temporary entry of service providers in accordance with the applicable legislation of each party. The Joint Committee examines services and investment issues and examines the adoption of liberalisation measures. The EU does not have a free trade agreement with Australia. They are negotiating for one, but they are currently working mainly under World Trade Organization (WTO) rules.

The agreement contains provisions on trade facilitation, under which contracting parties simplify trade procedures for related products and services, promote multilateral cooperation among themselves, and cooperate within the joint committee to facilitate trade. Both the EU and Canada will retain the right to freely regulate in areas of public interest such as environmental protection or human health and safety. [43] Canada and the EU have a long history of economic cooperation. With 28 Member States with a total population of more than 500 million euros and a GDP of 13,000 billion euros in 2012,[33] the European Union (EU) is the second largest domestic market in the world, foreign investors and traders. As an integrated bloc, the EU is Canada`s second largest trading partner in goods and services. In 2008, Canadian exports of goods and services to the EU totaled $52.2 billion, an increase of 3.9% over 2007, and imports from the EU amounted to $62.4 billion. Ceta will abolish most tariffs (import taxes) on goods traded between the EU and Canada. Tariffs on poultry, meat and eggs are maintained. The announcement of the CETA was also the first time that people in Canada and Europe could see the official text of the agreement.

The agreement was signed without public consultation. We are now told that no change is possible. Michel said the trade agreement, signed in October 2016 and entered into force in September 2017, increased trade by 24 percent for goods and 25 percent for services compared to before CETA level.
